Kensington Nannies Candidate Agreement

Kensington Nannies (The Agency) acts as an introduction agency (as defined in section 13(2) of the Employment Agencies Act 1973) when introducing Candidates to the Client for direct engagement by that Client.
Kensington Nannies enter into this agreement with you in good faith with the intent to provide our work finding services to you free of charge. We shall endeavour to deliver a high standard of duty & care throughout your search and beyond! We aim to build a long-lasting, mutually agreeable relationship of trust, loyalty & respect with you. Kensington Nannies do not send newsletters & group emails, nor do we sell your personal details to 3rd parties
- During your search we will suggest vacancies to you that align with your preferences.
- If you apply for a position, you have seen advertised by Kensington Nannies that you would like your c.v to be sent to & we haven’t suggested it to you, if your profile aligns with the criteria the family have asked for, we will happily introduce you.(Assuming that you haven’t already applied for it through an alternate source)
- Sometimes we are not able to respond to emails & return phone calls as promptly as we (and you!) would like to, please bear with us. It is in our mutual interests to find you a job we are not ignoring you, sometimes there just aren’t enough hours in the day for us to return all calls and emails & sometimes we just have no news or updates to report.
- Some clients take a long time to get back to us – so be it that :you are waiting to know if you have been invited by them for an interview or are being considered for their job don’t worry as soon as we know you will know!
- Where possible we will provide you with feedback on any interviews you have attended. If there is constructive feedback that could help you with your next interview, if you would like to hear it we will pass that on too.
- We DO want you to be happy with any introduction we have made so we are here to guide you if you need us to.
- Our relationship with you doesn’t end the minute we find you a job, throughout your employ with a family who we have introduced you to, we are here for you should you need support or have any queries.

- You authorize Kensington Nannies to seek work on your behalf.
- You have informed us that you wish us to seek employment within the field of Childcare
Contract & Terms of agreement between Kensington Nannies (Introduction Agency/The Agency) & You (Candidate) the work seeker:You, the candidate agree & confirm that the information you have supplied on the pre-registration / registration form, reference form & at interview is/are true and accurate, as is your CV & all other documents that you have supplied to Kensington Nannies. You grant Kensington Nannies permission to use this information responsibly at their discretion by appointing them to represent you in your search for employment and confirm that your personal details may be passed onto prospective employers as part of providing you with work finding services.
The information that you provide on the preregistration / registration form on any CV given, and information provided at interview & throughout the requirement process will be used by Kensington Nannies to provide you work finding services. In providing this service to you, your personal data including sensitive information such as Photo I.D, Police Clearance/DBS, reference details, qualifications & certificates will be included on a computerized database & in some cases in paper form. Once successfully registered, in the course of finding you suitable employment Kensington Nannies will be required to transfer your personal details and supporting documents provided, given to and obtained by Kensington Nannies during the course of your job search to our clients. You the candidate understand and give permission that any information given to and obtained by the agency during the process may be held for an indefinite period of time (usually 6 years) and this information may be relayed to future employers. We may check the information collected, with third parties or with other information held by us. We may also use or pass to certain third parties information to prevent or detect crime, to protect public funds, or in other way permitted or required by law.

You agree to/have obtain(ed) consent from your previous employers, that you are authorized to disclose their contact details to Kensington Nannies so that the Agency may confirm & verify your employment history and where applicable your suitability to work with children. As per legislation we are required by law to verify your previous employment, and check with previous employers, your suitability to work with children. (Before we may suggest you to any of our clients, Kensington Nannies must have a minimum of two positive reference from previous employers, who are also prepared to be contacted by prospective employers at point of offer) The majority of prospective employers would like all previous employment checked by Kensington Nannies where possible, therefore the more references you are able to provide the stronger your chances are of obtaining your desired job.
If you are using multiple sources to seek employment, you agree to take care that you do not apply for a position for which we have confirmed to make an introduction to on your behalf. You will not knowingly enter into an agreements with a client / third party with the intent to bypass Kensington Nannies if Kensington Nannies is/was the primary source of informing you of the vacancy and/or has made the introduction.
Kensington Nannies are not responsible for any interview expenses incurred by the Client or Candidate. During your search for work you may be provided with sensitive Data pertaining to a prospective Employer & their family. The information provided to you is confidential & you are therefore prohibited to share this information with a 3rd party. Should you do so, you would be breaking Data protection laws that could result in you being prosecuted/fined. Once you no longer lawfully require the information it must be securely destroyed.
You agree to keep Kensington Nannies informed of any interviews you have scheduled or undertaken with clients we have introduced you to & agree to notify the Agency immediately of the terms of any offer of an engagement which is made to you by introduction of Kensington Nannies .You agree to Notify the Agency immediately that the Clients offer of an engagement to you has been accepted & to provide details to the Agency of the terms agreed with the Client, together with & in addition to any documentary evidence as required/requested by the Agency to determine suitability for the engagement to proceed.
Kensington Nannies provide recruitment services to Clients who reside globally. During the course of your application, your details (including sensitive Data) may be transferred globally. Sharing data cross-border is essential to the Services so that you receive the same high-quality service wherever you are in the world, and in some cases may be necessary for the performance contract between us. As a result, we will/may, transfer Personal Data and Other Data collected in connection with the Services, to clients in countries where data protection standards may differ from those in the country where you reside. By appointing Kensington Nannies to assist in your job search you understand that we transfer your Personal Data globally by email & whilst we have security measures in place to protect your data, recipients of your details may not. In certain circumstances, courts, law enforcement agencies, regulatory agencies or security authorities in those other countries will be entitled to access your Personal Data. Some of the non-EEA countries are recognized by the European Commission as providing an adequate level of data protection according to EEA standards.
Whilst every care is taken to select vacancies deemed suitable for you, the final decision on the suitability of the role is the sole responsibility of you the candidate. The Agency will not be held responsible nor get involved with any conflict which should be resolved between employer (Client) & employee (Candidate) that may result in any loss, damage, delay or termination of the engagement. You, the candidate understand Kensington Nannies cannot be held responsible for any loss, damage, delay, and clash of personalities or for any other circumstances that may arise beyond its control and which should be resolved between the employer and employee.
You understand that once gainfully employed the employment contract is between you and the employer, and whilst we will endeavor to support you during the course of your employment with a client to whom we have introduced you, we have no legal right nor obligation to intervene on your behalf on contractual/employment disputes that may arise.
The Agency shall not be liable under any circumstances for any loss, expense, damage, delay, costs or compensation (whether direct, indirect or consequential) which may be suffered or incurred by the Candidate in arising from or in any way connected with the Agency whilst seeking an introduction or resulting engagement, or from the failure of the Agency to introduce any suitable introductions. Kensington Nannies are not responsible for any interview expenses incurred by the Candidate. No Liability shall be attached to the agency either in contract or in tort as a result of the act or omission of a hirer however so arising even if such act or omission is fraudulent or negligent.
You understand and accept that the agency can choose not to represent you at any time, now or in the future and may do so without notification or justification.

If you find employment through an alternate source, please notify us, so that we know you are not actively looking for work and do remember if we haven’t heard from you within 6years you will have to go through the whole registration process again so do get in touch from time to time (even if it is just to say Hi!)
