Should Nannies get paid extra to work over bank holidays?

This question may be quite a controversial one depending on who you speak to. However, for positions based in England the short answer is (surprisingly to some) no, unless of course specified otherwise in the employment contract. Workers in England do not need to get paid extra should they be asked to work over a public or bank holiday by their employer. “Bank or public holidays do not have to be given as paid leave. All staff, in England including nannies have a legal minimum holiday entitlement. An employer is required to declare their nanny’s holiday allowance in the contract of employment and administer holiday pay where it is due.

Almost all employees who work fulltime are lawfully entitled to 5.6 weeks’ paid holiday a year (known as annual leave or statutory leave entitlement). In England there is no automatic right for nannies (or any workers) to have bank holidays as a day off. If an employer requires the nanny to work on those days, they are entitled to do so” and it is a common myth that if a person works on a bank holiday they will get double time or time and a half. In short, it is up to the employer’s discretion!
